Ask a Lawyer Article on SingleDad.com, your number one resource for the newly divorced Dad. Why Should I have to pay Alimony and Child Support if my Ex makes more money than me?

Question:

My wife is about to file for divorce. She told me she will depend on me paying child support and alimony to live off of. My problem is she is a licensed real estate agent and is refusing to get a job. Why should I have to pay alimony if she has the same or more earning potential as me?

However, I would state that many states look at factors such as the parties’ health, the paying party’s ability to pay alimony, the parties’ educational backgrounds, the parties’ earning capacities and the conduct of the parties during the marriage. Many states also look to the property that the party requesting alimony is receiving in the the dissolution. Unfortunately, every states laws are different.
