Question:

I am trying to get custody of
my son who is in Georgia and I live in the state Washington. I need to know if
I can file for custody in my home state. His mom is currently incarcerated, has
been for a year and will be for several more years. The great uncle who is
seriously ill and on dialysis has paper custody but my son is living with his
aunt because the great uncle says he doesn’t understand my son and cant take
care of him.

They asked me to buy a ticket so they can send him to me, I did that and
they didn’t put him on the plane. The aunt he is living with says she can’t
handle him and if I don’t get him she will turn him over to the state. I need
some help please.

Answer:

I understand your need for
immediate custody of your son and his need to be with you. Custody matters are legally complicated
and require legal skill and strategizing.

For example, if this was an
Illinois case, I’d likely request the legal custodian to sign a proposed court
order transferring custody to my client and present it to the court as soon as
possible for entry. I would then direct my client to pick up his son
immediately. If the custodian was uncooperative, immediate and emergency court
intervention would be my next step. Consult with your attorney soon. If your
attorney needs help have him or her call me.
