Question:

I have a 4-year-old
daughter with a woman I lived with but never married. My name was never put on
the birth certificate. We have since split up. I have been giving financial
support and have had visitation. The mother is unstable and constantly
threatening to take my daughter and telling me that I will never see her again.
I need to know how to have my name put on the birth cert. and arrange
visitation
with my daughter.

Ask a Lawyer

Answer:

You need to act without delay in this situation to ensure
your daughter’s mother does not take flight. Seeking and obtaining a court
order preventing her from doing so needs to be addressed quickly with your
lawyer. If you don’t have counsel, retain someone immediately as time may be
critical. Also, if you have not signed a voluntary acknowledgment of paternity
or have not been adjudged the father through the court system, this step must
be seriously considered as well as seeking court ordered custody or access.

Your letter suggests that the mother might have mental
health issues which could call into question her ability to care for the child.
This might be a basis for you to seek custody of the child or to have the
mother undergo a court ordered psychological evaluation. A strategic plan should
be designed to protect your rights and ensure your daughter remains safe.
